  • No-fault divorce — New Jersey allows for “no-fault” divorce, which means you do not have to prove that your spouse did something wrong. No-fault divorce applies if you have been living apart from your spouse for more than 18 months or you both agree that the marriage is over due to “irreconcilable differences.”
  • Fault-based divorce — New Jersey also allows for a divorce where one party has committed some bad act. Grounds for fault-based divorce include adultery, desertion, addiction to alcohol or narcotics or extreme cruelty.
